The complete ban on online money games through the 2025 Act applies to games of chance, games of skill, and those that combine both. The Act prohibits advertising and promotion of such games and financial transactions related to these platforms cannot be processed by banks or payment systems. Authorities will also be empowered to block access to unlawful platforms under the Information Technology Act, 2000. Foreign investors and funds will still need to be careful while investing in Indian online gaming companies as foreign investment in any type of betting or gambling activity remains strictly prohibited under Indian foreign exchange control regulations. As discussed above, the Amendment Rules do not provide any clarity on online games that constitute betting or gambling and those that do not. In light of this, the Rules will act as a way to bridge the gap between unrestricted markets and a holistic regulatory environment to prevent malfeasance.

The jurisprudence pertaining to the same dates to RMD Chamarbaugwala v. Union of Indiai wherein the Supreme Court, while deliberating upon the same, held that a competition where success does not depend to a substantial degree upon the exercise of skill is to be recognised as gambling in nature. From thereon, the Supreme Court, in the catena of judicial pronouncements, has analysed the law relating to the same and held that despite there being an element of chance, if a game is preponderantly a game of skill, it would nevertheless be a game of mere skill. Accordingly, the expression ‘mere skill’ (used in the Public Gambling Act) would mean a substantial degree or preponderance of skill. The government says that online money games are leading to increased financial losses and suicide cases across the country. jeetwin result Online gaming in India has seen remarkable growth, evolving from simple single-player games in the early 1990s into a thriving multi-billion-dollar industry in 2022. ED Arrests WinZO Cofounders in Money Laundering After Rs 505 Cr Linked to Alleged Illegal Real-Money Gaming

  • Therefore, based on the above, it can be concluded that games of chance would fall within the ambit of betting and gambling, while games of skill played with or without stakes would not.
  • The jurisprudence pertaining to games of skill v. games of chance remains the epicentral force in regulating this sector.
  • Furthermore, the Karnataka High Court in Gameskraft Technologies Private Limited v. DGGIv held that rummy, whether played with or without stakes, is a game of chance and does not constitute betting or gambling.
  • The arrests mark a significant escalation in the government’s scrutiny of India’s online gaming industry, which has been under the scanner for alleged tax evasion, dubious payment flows, and compliance failures.

“Our cross-functional teams are actively exploring new opportunities and future-ready solutions… to unlock the full potential of India’s digital gaming economy,” the spokesperson added. The company further said that it will now turn its attention to identifying fresh prospects that fit within the changing legal framework. Gameskraft stated that it has settled all regulatory obligations and implemented measures to protect its employees, partners, vendors, and service providers. Currently, he is the Managing Partner at Majmudar & Partners, a leading Indian law firm, and also heads its transactions practice. Mr. Hirani combines superlative Indian law acumen with an international skill set and has been ranked as one of the most in-demand lawyers in India by Chambers Asia.

The Centre stated that online money games are rapidly increasing, leading to fraud, money laundering, tax evasion, and, in some cases, funding of terrorism, which are a threat to national security. Any individual or entity providing credible information leading to the identification and prosecution of illegal online betting operators will be protected from retaliation and may be eligible for a reward. The identity of whistleblowers will be kept confidential, except where required by a court of law. Additionally, central legislations like the Public Gambling Act of 1867 and the Information Technology Act of 2000 influence gaming activities by addressing key issues such as illegal gambling and cybersecurity. The recent amendments to the IT Rules, 2021, signify a growing recognition of online gaming’s economic potential while ensuring a safe gaming environment through robust governance.

Against this backdrop, the Act’s blanket prohibition undermines India’s Digital India and startup agenda. While government white papers and budget speeches hail online gaming as a driver of employment and a key part of the Animation, VFX, Gaming, and Comics sector, the Act criminalises its most monetizable segment without licensing or harm-mitigation pathways. This inconsistency signals policy instability, whereby a sunrise sector today could be labelled a social ill tomorrow, undermining India’s digital economy and deterring venture capital investment. Under the Promotion and Regulation of Online Gaming Bill 2025, real money gaming will be banned in the country. After receiving presidential assent on August 22, it became law and was implemented from October 1.
